Prehearing unit moves to 1120 Lincoln Street


Effective October 15, 2001, the workers' compensation prehearing administrative law judges and support staff of the prehearing unit of the DWC have relocated to the Denver office of the Division of Administrative Hearings (DOAH) at 1120 Lincoln Street, Suite 1400, Denver, Colorado 80203. Scheduling, filing of documents, prehearing conferences and settlement conferences will now take place at that location. A prehearing docket will continue to be set in Colorado Springs for the Friday of the first and third week of each month. The services provided by the prehearing unit will not change.
Currently, the telephone number to reach the prehearing unit is (303) 894-2500. The fax number is (303) 894-2542. Each fax should clearly indicate on the cover page that it is to be directed to the prehearing unit. DOAH is planning to make changes in its telephone system in the near future, and new dedicated telephone and fax numbers will be assigned to the prehearing unit.
The DWC has also worked on promulgating new rules to govern the filing of pleadings. In general, except for specific matters under the authority of the DWC Director, all pleadings will be filed at DOAH. The rules can be found at the DWC website at http://www.coworkforce.com/DWC.


Victories In the trenches

James Clifton defeated a claim for permanent total disability benefits before Judge Gartland in Jones v. U.S. Sack Corporation and California Indemnity Insurance Co. 

Richard Bovarnick successfully recovered a credit for the insurer to be applied against future medical benefits in Indemnity Insurance Co. v. AMF, Inc., following a Jorg-ensen arbitration. The federal magistrate agreed that forty percent of the settlement proceeds was for economic loss.
